If your baby is receiving neonatal care and your job is governed by Northern Ireland employment law, do not assume that Great Britain’s Neonatal Care Leave and Pay scheme applies. As checked on 29 October 2026, Northern Ireland did not yet have a separate neonatal-care leave and pay entitlement in force. The NI Department for the Economy describes the change as a proposed reform, and the Good Jobs Employment Rights Bill had not completed the process needed to create an entitlement.
The Great Britain scheme is separate
The NI proposal is not a claim route yet
Existing family leave may still apply
What is the current Northern Ireland position?
The UK’s Neonatal Care (Leave and Pay) Act 2023 does not itself create the GB entitlement in Northern Ireland. Its Explanatory Notes say employment law is devolved to NI, that the Assembly would decide whether similar rules should apply there, and that the sections creating Neonatal Care Leave and Pay extend and apply to Great Britain.
The NI Department for the Economy’s Good Jobs page lists neonatal leave and pay among proposed employment-law reforms. In the Assembly on 14 September 2026, the Economy Minister said the draft Good Jobs Bill remained stuck in the Executive, although she believed there was still time for it to be introduced during the shortened mandate. A written answer on 3 August 2026 said the draft Bill had been shared with Executive colleagues and that she was still seeking agreement. These are proposals and process updates; they are not an effective date, final scheme rules or authority to submit a neonatal-pay claim.
What should you check with your employer now?
There is no separate NI neonatal-care claim form or statutory neonatal-pay route identified in the current official guidance. Contact your employer or payroll promptly and ask which existing leave or contractual policy could apply to your circumstances. Get any agreed leave dates, pay treatment and required evidence in writing. A workplace policy may offer more than the statutory minimum, but that is separate from a government entitlement.
The relevant statutory route depends on your role and the facts:
- The birth parent can check the NI Maternity Leave guide and the separate maternity-pay rules.
- A qualifying partner can check the NI Paternity Leave guide. It has its own service, employer-notice and leave-window rules; neonatal care does not automatically extend them.
- Parents considering a later transfer of leave can read the NI Shared Parental Leave and Pay guide. Its eligibility and booking rules remain separate.
- The NI unpaid Parental Leave guide explains that child-care right. It is not a neonatal-specific entitlement and is not paid by a neonatal benefit.
Maternity Pay, Statutory Paternity Pay and Shared Parental Pay each have their own eligibility and payroll process. None becomes payable solely because a baby is receiving neonatal care. Do not use Great Britain’s seven-day qualifying-care rule, 12-week maximum or notice timetable to decide an NI claim.
What may change under the Good Jobs Bill?
The Department for the Economy lists neonatal leave and pay as proposed family-related leave reforms. Until a Bill is introduced, scrutinised, passed and brought into force, important details remain unsettled: who would qualify, which babies and care periods would count, how much leave or statutory pay would be available, the employer notice and evidence rules, the pay administrator, and the start date. The GB scheme is a useful comparison, but it does not fill in those NI details.
Check the Department’s Good Jobs page and current NI legislation before relying on a future entitlement. If the Bill progresses, this guide needs a fresh source review before adding any qualification, claim deadline or payment figure.
